New rules on health markings for heated tobacco products

The EU Commission intends to amend the Tobacco Products Directive in a way that heated tobacco products also fall under the prohibition of added characterising flavour and flavourings and also have to comply with the combined health warnings. The transition period is only six months after the entry into force.

Before the new act is adopted, likely before the summer break, a report on the market developments of heated tobacco products will be published. Please find the preliminary results here. European Parliament and the Council will have the right to scrutinise the adoption of the Delegated Directive.

Controversies concern:

  • introduction of a new definition of heated tobacco products in the delegated act. Currently, there is no definition of heated tobacco products. It is still unclear whether the definition should not be part of the main legislative act;
  • need for a clear distinction between heated tobacco and smokeless tobacco;
  • some Member States ask for a longer transition period.
